Corporate Manslaughter Act 2007

The Corporate Manslaughter and Corporate Homicide Act 2007 came into effect on 6th April 2008.

Companies and organisations can now be found guilty of corporate manslaughter as a result of serious management failures resulting in a gross breach of a duty of care.

The Act details the criminal liabilities of companies where serious failures in the management of health and safety result in a fatality. Full details can be found http://www.opsi.gov.uk/acts/acts2007/ukpga_20070019_en_1.

The liability of directors, board members or other persons under health and safety law and general criminal law is unaffected. Any individuals can still be prosecuted for separate health and safety offences.

This puts even greater emphasis on getting health and safety right in the Building and Construction Industry. The main focus will be to have an accountable health & safety management system. Sounds a bit scary but it’s actually not that difficult.
